Penalty: Apprentice Jockey Temyia Taiaroa is fined $250

Evidence:

Following the running of Race 8, the Respondent Ms Taiaroa admitted a charge alleging excessive whip use prior to the 100 metres.

Apprentice Mentor Ms K Clapperton was present to assist.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films Mr Davidson demonstrated that Ms Taiaroa struck her mount 6 times from the straight entrance to the 100-metre mark.

Ms Taiaroa accepted she had used her whip 6 times, being 1 over the allowed number.

Decision:

As Ms Taiaroa admitted the breach the Adjudicative Committee finds the breach proved (Rule 915(1)(d) refers).

Submissions For Penalty:

Mr Davidson produced Ms Taiaroa’s record which indicated she had received a warning in April at Hastings, but otherwise had a clear record for the preceding 6 months.

Ms Taiaroa had nothing to add.

Reasons For Penalty:

The Penalty Guide starting point for a breach of this nature is a $250 fine for a second offence when a Rider has used the whip 1 over the limit (as per updated NZTR Penalty Guide dated 1 March 2022).

After considering the film evidence and the submissions, the Adjudicative Committee determined there are no compelling reasons to depart from the starting point set out in the Penalty Guide. On that basis Ms Taiaroa is fined the standard amount.

Conclusion:

Ms Taiaroa is fined $250.
