Evidence

Following the running of Race 2, the Respondent Ms T Taiaroa, admitted a charge alleging excessive whip use prior to the 100 metres.

Apprentice Mentor Ms K Clapperton, was present to assist.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); 

Using the available race films, with the rear view being the most useful, Mr Goodwin demonstrated that the Respondent struck her mount 6 times from the straight entrance to the 100-metre mark.

Ms Taiaroa agreed that she had used the whip 1 more time than allowed. Neither she nor Ms Clapperton had further comment.

Decision

As Ms Taiaroa admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions For Penalty

Mr Goodwin produced Ms Taiaroa’s  record which indicated two previous charges in the previous 6 month period:

31/12/22  Hastings    6 strikes   3 days + $500

27/5/23  Trentham    8 strikes    5 day suspension

Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of February 2023).

Reasons For Penalty

The Penalty Guide starting point for a third breach when 1 strike over the Guidelines, is a fine of $500.

After considering the film evidence, the submissions and having due regard for the number and frequency of strikes, the Adjudicative Committee determined there were no compelling reasons to depart from the starting point set out in the Penalty Guide.

On that basis, Ms Taiaroa is fined $500.

Conclusion

The Respondent Ms Taiaroa, is fined $500.
