SUMMARY OF FACTS:

Subsequent to the running of Race 8 (Caro Meo Bayleys Fashion in the Field 1200) an Information was lodged by Mr Oatham alleging a breach of Rule 638(1)(d) in that T Taiaroa  (Kapinos) allowed her mount to shift in near the 900m mark dictating Tellall inward onto Power ‘n’ Glory which was checked. Ms Taiaroa advised she understood the charge and this was confirmed by Ms Clapperton.

SUBMISSIONS:

The incident was outlined by Mr Goodwin using film.  Approaching the 900 metres Ms Taiaroa was positioned approximately four out from the fence with to her inside being Tellall (Mr M McNab), Power ‘n’ Glory (Mr M Singh) and Durham Lad (Ms D Hirini). Ms Taiaroa sought to push her mount to the lead and fence. When doing so she was insufficiently clear of the horses to the inside causing the check as outlined within the Information. Mr Goodwin noted that at the time of the incident Power ‘n’ Glory was over racing and Mr Singh was looking to ease. He also added that Mr McNab had informed him that he had alerted Ms Taiaroa to ‘what was going on’.

Ms Taiaroa  did not offer comment beyond saying she did not hear Mr McNab. Ms Clapperton contended that the charge was marginal at best.

REASON FOR DECISION:

As Ms Taiaroa admitted the breach, it was deemed to be proved.

SUBMISSION FOR PENALTY:

Mr Goodwin outlined Ms Taiaroa’s  record for careless riding breaches over the last twelve months.

23/1/2021 4 days plus $250

7/8/2021 3 days plus $250

Stewards contended the breach was at the low range.

Ms Taiaroa sought deferment of any penalty given riding engagements to 30th September 2021.

REASON FOR PENALTY:

The Committee considered submissions as presented. In setting penalty, the Committee had regard to the new Penalty Guidelines effective from 1st September 2021 where the low range starting point is 5 national days suspension. On balance this is considered an appropriate penalty.

CONCLUSIONS:

Accordingly, Ms Taiaroa’s license to ride is suspended from the close of racing on 30th September 2021 up to, and including, racing on 7th October 2021 – 5 national riding days.
