Facts:

Apprentice Jockey T Taiaroa admitted a breach of the Rule in that she struck her mount LOVE LETTER excessively prior to the 100 metre mark.

The films were shown and the strikes counted and confirmed.

Decision:

As the breach was admitted it was found proved.

Submission on Penalty:

Mr Coppins informed the Adjudicative Committee that Miss Taiaroa’s record under this Rule was average. She has had three other charges – 16 July 2022 fined $500 – 13 August 2022 6 day suspension and 13 November 2022 7 day suspension.

He pointed out that Miss Taiaroa’s mount went on to win the race and asked for this to be taken into account.

Miss Taiaroa had no comment.

Reason for Penalty

This was Miss Taiaroa’s fourth breach of this Rule and it was pointed out to her that as a promising Apprentice her record was not good. It was suggested that she takes time to talk with the Riding

Master Miss Clapperton to help address the problem. She agreed that she would.

An aggravating factor was that she went on to win the race and it was felt that this must be reflected in the penalty.

Conclusion:

A deferment was asked for and agreed to.

Miss Taiaroa’s License to ride was suspended from the conclusion of racing on Saturday 7 January until the completion of racing on Thursday 12 January. (Three days).  A fine of $500 was also imposed.
