Penalty: Apprentice Rider Temyia Taiaroa - fined $500

Evidence:

Following the running of Race 5 an Information was lodged alleging the Respondent had committed a breach of the said rule. Details are

‘in that she struck her mount Rocket Science 6 times prior to the 100 metre mark

Ms Taiaroa confirmed to the Adjudicative Committee that she admitted the breach. Apprentice Mentor Ms Clapperton was present to assist and confirmed that she was comfortable Ms Taiaroa understood her obligations under the Rule.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in slapping motion down the shoulder with the whip hand remaining on the reins)

Using the available film Stewards demonstrated that the Respondent struck her mount on six occasions from the the top of the straight to just prior to the 100 metre mark. Ms Taiaroa did not offer comment beyond agreeing with the count.

Decision:

As the Respondent admitted the breach the Adjudicative Committee found the breach proved.

Submission for Penalty:

Stewards produced the Respondent’s record – as it related to this breach type within the last 6 months. Noted was a warning issued on 16/4/2022 and a fine imposed 18/6/22. Recommended was a penalty in line with current Guidelines.

Reasons For Penalty:

Current Penalty Guidelines – effective 1st March 2002 – provide for a $500 fine in circumstances of  1 additional strike, 3rd offence. The Adjudicative Committee considered that in this instance there were no aggravating factors and deemed that a fine at this level was therefore appropriate.

Conclusion:

Apprentice Jockey Ms Temyia Taiaroa is fined $500.
