FACTS

Ms Butler, with the assistance of Mrs Allpress, admitted a charge of careless riding.

The charge being that Ms Butler allowed her mount “RONIN POROTENE” to shift inwards when not sufficiently clear of “HARDTIMES” (M Hudson), which was checked passing the winning post on the first occasion.

Ms Butler said that she understood the Rule, charge and confirmed that she admitted the breach.

Mr Oatham showed film replays and showed where Ms Butler let her mount shift in when not clear of “HARDTIMES”, which was checked.  Mr Oatham said that Ms Butler and her mount were one length clear when shifting.

Mrs Allpress said that Ms Butler was following a horse on the bend and just dropped in on Mereana Hudson.  She said when Mereana called, Ms Butler pulled off immediately. She said after that, Mereana had lots of room.  Mrs Allpress said that Ms Butler had had only two rides over ground.

Ms Butler told the Adjudicative Committee that she had only had 20 raceday rides and that it was her first charge of careless riding.

PENALTY SUBMISSIONS

Mr Goodwin confirmed that it was Ms Butler’s first careless riding charge and placed the carelessness in the mid-range category.

Mrs Allpress said that there were mitigating factors to be considered.

Ms Butler said that she had rides on 29 October.

REASONS FOR PENALTY

The Adjudicative Committee placed the carelessness in the mid-range, and after considering the Penalty Guide starting point and the mitigating features, it was determined that a 5-riding day suspension was an appropriate penalty.

CONCLUSION

Ms Butler’s Apprentice Jockey’s Licence was suspended from 29 October 2022 up to and including 5 November 2022 (5 days).
