Penalty: Apprentice Jockey Ciel Butler is suspended for 5 National Riding Days
Evidence:
Following the running of Race 2, the “Pavemasters 1300”, Ms Algar, Stipendiary Steward, presented an Information charging Apprentice Rider Ms C Butler, with a breach of Rule 638(3)(g)(i), excessive use of the whip prior to the 100 metres from the finish.
Ms Butler, assisted by Ms Clapperton, admitted the breach of the Rule.
The race films depicted that “TANZANITE ROSE”, ridden by Ms Butler, was straightened at the 400 metre mark. It commenced a wide determined run to eventually finish a close third. However, Ms Butler had struck her mount with the whip 7 times before the 100 metre mark and a further 4 times before the finish mark. That comprised the breach of the Rule.
Decision:
As the charge was admitted, it was deemed proved.
Submissions for Penalty:
Ms Algar advised that Ms Butler has had two breaches of the Whip Rule in the past 6 months, namely on 17 June 2023 and 7 December 2023. Ms Butler is about to serve a suspension from 17 December until 24 December 2023.
Ms Clapperton and Ms Butler made no penalty submissions.
Reasons for Penalty:
The appropriate penalty, which is imposed, is a suspension of Ms Butler’s Licence to ride for 5 National Riding Days.
Conclusion:
Ms Butler is suspended from the end of racing on 24 December 2023 and to conclude at the end of racing on 30 December 2023.
