Background:

Following the running of Race 8, the ‘Ideal Racing Thanks Ascot Bloodstock’ an Information was lodged alleging a breach of Rule 638(3)(g)(i).

Details in respect of the Information are as follows:

‘struck her mount ‘Beaudz Well’ with the whip eight times prior to the 100 metre mark’ .

Rule 638(3)(g)(i) provides: a rider must not: (i) except as provided for in (iii)(A) and (iii) of this sub rule, strike a horse with a whip more than 5 times prior to the 100-metre mark (other than slapping motion down the shoulder with the whip hand remaining on the reins); 

Ms Butler confirmed to the Adjudicative Committee that she understood the Rule and admitted the breach.

Evidence:

Using available film, Stewards identified the incident. Ms Butler is seen to strike her mount on 8 occasions – the first just prior to entering the home straight and the 8th just short of the 100 metre mark. Ms Butler confirmed that she agreed with the count.

Decision:

As the charge was admitted, it was deemed proved.

Penalty Submissions:

Stewards referred to the current NZTR Penalty Guide. It was noted that this breach was the Respondent’s 2nd under this Rule within the last six months. Ms Butler did not offer comment although did ask that if penalty extended to a suspension, could it commence after riding engagements were satisfied on 16th December 2023.

Reasons for Penalty:

The Adjudicative Committee was satisfied that the offence was, through film, identified and confirmed. NZTR Penalty Guide provides for a 5 day suspension for this particular breach – 3 additional strikes 2nd offence. The Adjudicative Committee did not identify any aggravating factors. As such, a 5 day suspension was deemed appropriate. Ms Butler’s request for deferment was granted.

Conclusion:

Apprentice Jockey Ms Ciel Butler’s Licence to ride in races is suspended for 5 national riding days from the close of racing on the 16th December 2023, up to and including, racing on 24th December 2023.
