FACTS

Ms C Butler, Rider of ‘HI YO SASS BOMB’ admitted a breach of Rule 638(3)(g)(i).

The breach being that she struck her mount 6 times with the whip prior to the 100m.

Ms Butler said that she understood the Rule and the charge.

Film replays confirmed that 6 strikes had been applied prior to the 100m.

Ms Butler and Ms Clapperton did not comment.

DECISION

As the charge was admitted, it was found proved.

PENALTY SUBMISSIONS

Mr Goodwin said that this breach was the fifth for Ms Butler within the last six months.

The Penalty Guide was referred to with a term of suspension recommended by the Applicant.

Ms Clapperton said that Ms Butler was riding super and that she had a plan in place for Ms Butler regarding her whip use.

REASONS FOR PENALTY

The Adjudicative Committee took into account Ms Butler’s poor record, admission of the breach and that the number of strikes (6) was only one more than is permitted.

CONCLUSION

Ms Butler’s Apprentice Jockey’s Licence was suspended from 26 June up to and including 5 July 2023 (5 National days).
