Penalty: Apprentice Jockey Ciel Butler is suspended for 7 days

FACTS

Ms Ciel Butler, the Rider of ‘COMEDY’, admitted a breach of Rule 638(3)(g)(i).  The breach being that she struck her mount six times with the whip prior to the 100m (5 is the limit).

Ms Butler said that she admitted the breach and knew the Rule and charge.

Film replays confirmed that six strikes had been applied.

DECISION

As the charge was admitted, it was found proved.

PENALTY SUBMISSIONS

The record showed that this was Ms Butler’s 5th breach of the Rule in the last six months.  The Penalty Guide starting point is for a suspension of 5 days.

Due to Ms Butler’s record, Mr Simpson asked that consideration be given for an uplift.

Ms Clapperton did not comment other than to say, that Ms Butler said that she thought that she had hit it fewer times.

REASONS FOR PENALTY

The Penalty Guide was considered, as was the very poor record, plus the fact that Ms Butler had breached the Rule earlier in the day.  This earlier breach resulted in a 2-day suspension and a $500 fine.

After careful consideration of all those matters, an uplift of 2-days was considered appropriate.

CONCLUSION

Ms Butler’s Apprentice Jockey’s Licence was suspended from 17 May to 27 May inclusive (7 National Days).
