Penalty: Apprentice Jockey Ciel Butler is suspended for 2 days and fined $500

FACTS

Ms Butler the Rider of ‘WINKLE BAY’, was charged with using her whip 6 times prior to the 100m (5 is the limit).

Ms Butler said that she understood the Rule, charge and confirmed that she admitted the breach.

Mr Goodwin showed film replays and identified the 6 strikes that were applied.

Ms Butler agreed that it was 6 times.

DECISION

As the charge was admitted, it was deemed proved.

PENALTY SUBMISSIONS

Mr Goodwin said that this was Ms Butler’s fourth breach of the Rule within six months, with the most recent being on 21 January 2023 with a fine of $500 imposed.

The Penalty Guide was referred to.

Ms Clapperton said that Ms Butler has a good rhythm and it was unfortunate that she was one over.

Ms Butler said that she would start any suspension after 11 March.

REASONS FOR PENALTY

The Penalty Guide starting point for a fourth breach within six months is 2-days suspension plus a fine of $500.

As there was not any reason to depart from the starting point, it was the penalty arrived at.

CONCLUSION

Ms C Butler had her Apprentice Jockey’s Licence suspended from close of racing on 11 March to 15 March 2023 (2-days), with a fine of $500 imposed.
