Background

Stipendiary Steward Mr Davidson alleged that in Race 9, Mr Muniandy allowed his mount ANTICIPATE to shift in when not clear at approximately the 1200m mark, causing interference to JUSTANACE, K Chowdhoory.

Mr Davidson asked Stipendiary Steward Mr Chris Simpson, to demonstrate on the videos, nearing the 1200m mark, Mr Muniandy has crossed over in front of JUSTANACE when not sufficiently clear of JUSTANACE, causing that horse to be checked.

Mr Simpson stated that Mr Chowdhoory’s horse was racing unkindly at the time, however Mr Muniandy was not a length clear when crossing over.

Mr Muniandy said that he had made an error of judgement crossing over too soon. His horse was over racing at the time.

Decision

As Mr Muniandy has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record which showed 4 breaches of the the Careless Riding Rule. He was suspended for 6 days in February, 5 days in March, 5 days in October and a further 5 days in December.

Mr Davidson describe the breach as low range.

Mr Muniandy accepted Mr Davidson’s assessment of the breach. He requested that any suspension start immediately.

Reason for Penalty

The breach is assessed at the low end of the scale. On this occasion, Mr Muniandy has made an error of judgement crossing over too soon when not sufficiently clear. It is accepted that JUSTANACE was also racing unkindly at the time of the incident.

A 7 day starting point is appropriate on this occasion, given Mr Muniandy’s riding record over the past 12 months. This, being his 5th breach in that time frame. A one day reduction is given for his admittance of the breach.

Conclusion

Mr Muniandy is suspended from the conclusion of racing on the 18th of February 2023, up to and including the 2nd of March 2023. This is 6 days.
