Penalty: Jockey Shankar Muniandy was fined the sum of $500

Evidence:

At the conclusion of Race 10 Stipendiary Steward Mr M Davidson filed an Information alleging Jockey Mr S Muniandy under Rule 368(3)(g (i) struck his mount KAARERAWAY six times prior to the 100m.

Mr Muniandy admitted the breach and confirmed he understood the Rule. The Rule provides that a Rider must not strike a horse with a whip more than five times prior to the 100m.

Submissions:

Mr Munro (Stipendiary Steward) showed a video replay of the final 400m of the race pointing out KAARERAWAY ridden by Mr Muniandy who was in a prominent position. Mr Munro highlighted Mr Muniandy using his whip and using it on a clear 6 occasions prior to the 100m.

Mr Muniandy said that he accepted the alleged count of six strikes, he added that he simply had miscounted.

Decision:

Mr Muniandy has admitted the breach which is found proved accordingly.

Submissions For Penalty:

Mr Davidson stated that Mr Muniandy had one previous breach (Otago Racing Club 26/12/2021 $250 fine) prior to today’s second breach under this Rule where he received a fine of $500 (7 strikes) and that it was indeed unfortunate that another breach had occurred today. The revised Penalty Guidelines for a third breach of one additional strike (six) is a $500 fine.

Mr Muniandy had no submissions on penalty.

Reasons For Penalty:

This is Mr Muniandy’s third breach of the Rule. The NZTR Revised Guidelines as of the 1st March 2022 allow for a $500 fine (6 strikes).

Conclusion:

Mr Muniandy was fined a sum of $500 and was reminded of his professional obligations.
