EVIDENCE:
Following the running of Race 8, Chief Stipendiary Steward Mr John Oatham presented a second Information alleging a breach of Rule 638(1)(d) by Class A Jockey Mr Shankar Muniandy.
A hearing on the day was adjourned sine die and heard at Phar Lap Raceway on 27 April 2023.
Mr Muniandy stated he was conversant with the Rule and the Charge and confirmed he admitted the breach.
Mr Oatham had Mr Davidson identify Mr Muniandy racing in behind the leaders at approximately the 750m. Mr Oatham said Mr Muniandy has shifted his mount outwards, forcing MISS LAYLA out onto BETTY SPAGHETTI and FAMILY TIES, who were hampered losing ground.
Mr Muniandy said he misjudged his move and went a fraction too far.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham stated Mr Muniandy has now had 4 previous breaches under the Rule after being charged for the indiscretion earlier in this race. His record now reads as follows:
1 October at Riccarton – 5 days.
30 December at Kurow – 5 days.
18 February at Ascot Park – 5 days.
22 April at Riccarton – 5 days.
Mr Oatham said Mr Muniandy’s record can now certainly be assessed as an aggravating factor. He said he believed this breach was a little worse than that of Mr Muniandy’s carelessness earlier in the race.
Mr Muniandy made no submissions on Penalty.
REASONS FOR PENALTY:
The Penalty Guidelines provide a 5-day starting point for a low-level breach of the Rule. The Adjudicative Committee agrees with Mr Oatham, this breach is a little worse than Mr Muniandys’ earlier breach and adopt a 6-day starting point.
Taking into account the race being “Black Type” and now a poor record, an uplift of two days is added to the starting point. The Adjudicative Committee affords Mr Muniandy a one-day discount for his admission of the breach.
The Adjudicative Committee in this case, considers a 7-day suspension to be an appropriate penalty.
CONCLUSION:
Accordingly, Mr Muniandy’s Licence to ride in races is suspended from the close of racing on the 4 May 2023 up to and including racing on the 13 May 2023.
