Evidence:

Following the running of Race 3, “The Coupland’s Bakeries Maiden”, Mr Oatham presented an Information charging Mr Muniandy with a breach of the Whip Rules, Rule 638(3)(g)(i), in that he struck his mount “LADY’S LEGACY” 6 times prior to reaching the 100 metres mark.

Mr Muniandy admitted the breach.

Mr Oatham identified from the race films, Mr Muniandy applied his whip 6 times well before the 100 metre mark, before desisting until after that mark. “LADY’S LEGACY” then ran on well to win the race.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Oatham advised that Mr Muniandy had had previous breaches of this Rule in the last 6 months and suggested a starting point fine of $500.

Mr Muniandy accepted that he had to be fined but said he had only limited rides and it was expensive to travel from Dunedin.

Reasons for Penalty:

Any aggravating feature by the previous breaches is actually incorporated into the suggested starting point.  “LADY’S LEGACY” won the race, but the forfeiting of the winning Rider’s percentage ($420) plus a little more is sufficient sanction in this case.

Conclusion:

Accordingly, Mr Muniandy is fined $500.
