Penalty: Jockkey Shankar Muniandy was fined the sum of $500.

Evidence:

At the conclusion of Race 9, Stipendiary Steward Mr Davidson provided an Information alleging that Jockey Mr S Muniandy under Rule 638(3)(g)(i) used his whip on his mount WUDDZZ seven times prior to the 100m.

Mr Muniandy admitted the breach and confirmed he understood the Rule and was present throughout the hearing.

The Rule provides that the Rider must not strike a horse with a whip more then five times prior to the 100m.

Submissions:

Stipendiary Steward Mr Munro showed a video replay of the final 400m of the race. He highlighted Mr Muniandy using his whip on his mount WUDDZZ from about the 300m mark to the 100m mark on seven occasions.

Mr Muniandy said he accepted the alleged number of counts and that he’d simply misjudged the number of strikes.

Decision:

Mr Muniandy has admitted the breach which is found proved accordingly.

Submissions For Penalty:

Stipendiary Steward Mr Davidson stated that Mr Muniandy had one previous breach under this Rule on 26/12/2021 at Otago Racing Club and was fined the sum of $250. The NZTR Revised Penalty Guidelines from 1st March 2022 states two additional strikes for a second breach equates the sum of $500.

Mr Muniandy had no submissions on penalty.

Reasons For Penalty:

The video evidence was very clear of Mr Muniandy striking his horse WUDDZZ seven times. The NZTR Revised Guideline states for two additional strikes and a second offence a fine of $500 to be appropriate.

Conclusion:

Mr Muniandy is fined a sum of $500.
