Background:
Mr Davidson alleged that in Race 1, Mr Muniandy “allowed his mount PERIA’S LEGACY to shift inwards when not clear of TAIL LIGHTS which was then dictated inwards on to BLUE SOLITAIRE which was crowded and checked near the 1000 metres.”
Ms Algar demonstrated on the videos that the Respondent was racing mid-field and shifted from a 3-wide to a 2-wide position when not clear of the runners to his inside. Ms Wynne (BLUE SOLITAIRE) was crowded and eventually checked. Mr Muniandy said he was following Mr Johnson and had thought he was clear when he shifted across. He was looking for cover and had then wanted to run on.
Decision:
As Mr Muniandy has admitted the breach, it is found to be proved.
Submissions as to Penalty:
Mr Davidson produced the Respondent’s record which showed two breaches of this Rule. On 19 February Mr Muniandy was suspended for 6 days and again for a similar length of time on 11 March. Mr Davidson described this as not a bad record and submitted a 6-day starting point was appropriate. Mr Muniandy had nothing further to add other than he wanted a deferment of any suspension until after Timaru.
Reasons for Penalty:
We believe the breach is at the lower end of mid-range and take a 6-day starting point. While Ms Wynne was checked briefly, she went on to win the race. After credit for the admission of the breach, the penalty is a 5-day suspension.
Conclusion:
Mr Muniandy is suspended from the end of racing on 7 October up to and including 14 October 2022.
