EVIDENCE:

Following the running of Race 8, Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(1)d) by Class A Jockey Mr Shankar Muniandy.

A hearing on the day was adjourned sine die and heard at Phar Lap Raceway on 27 April 2023.

Mr Muniandy stated he was conversant with the Rule and the Charge and confirmed he admitted the breach.

Mr Oatham had Mr Davidson identify Mr Muniandy, on the available videos, beginning smartly from the barriers and settling close to the lead. Mr Oatham said passing the 1700, Mr Muniandy has looked to his inside and a short time later, has shifted his mount down to the rail, where MISS DUNSFORD was forced to check. He said Mr Muniandy was a shade unlucky, because MISS DUNSFORD had been ridden quickly into the gap which Mr Muniandy had previously thought was empty. Mr Davidson said GENERATION JOY was barely a length clear when shifting in.

Mr Muniandy had nothing to add.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham stated Mr Muniandy has 3 previous breaches under the Rule.

1 October at Riccarton – 5 days.

30 December at Kurow – 5 days.

18 February at Ascot Park – 5 days.

Mr Oatham said Mr Muniandy’s record may be assessed as neutral, but this race was a Black Type Race and an uplift in penalty would be appropriate.

Mr Muniandy made no submissions on Penalty but asked if he could start any suspension immediately.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 5-day starting point for a low-level breach of the Rule, which the Adjudicative Committee views this to be.

The Warstep Stakes, being a Black Type Race, an uplift in penalty of one day is added and the Adjudicative Committee affords Mr Muniandy a one day discount for his frank admission of the breach, subsequently resulting in a 5 day suspension.

CONCLUSION:

Accordingly, Mr Muniandy’s Licence to ride in races is suspended from the close of racing today, up to and including racing on the 4 May 2023.
