EVIDENCE:

Following the running of Race 5, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(1)(d) by Class A Rider Ms Samantha Wynne.

Ms Wynne stated she understood the Rule and the charge and confirmed she admitted the breach.

Mr Davidson had Mr Oatham identify Ms Wynne (ARDOUR) racing 3 or 4 horses out from the rail at approximately the 1600 and pointed to her shift into the line of ZAPPA JAK (L Sutherland), which was dictated inwards checking ROMANTIC COMBO (J Doyle).

Mr Oatham said Ms Wynne wasn’t helped by Ms Sutherland not easing slightly, but said she was not obliged to do so and didn’t.

Ms Wynne said she was only a stride away from being clear of Ms Sutherland.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Ms Wynne had a previous breach on October 28 where she was suspended for 4 days, which was low range.

Mr Davidson said today’s breach was low range and Ms Wynne deserves some credit for her record and admission.

Ms Wynne made no submissions on penalty but asked for any proposed suspension to begin after 22 November.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 5-day suspension for a low range breach of this Rule.

The Adjudicative Committee, in assessing an appropriate penalty, found if a normal approach was taken, and a 4-day suspension imposed, there would be no South Island day included in Ms Wynne’s penalty. Having considered this, the Adjudicative Committee was compelled to extend penalty to a 5-day duration to achieve a meaningful sanction.

Deferment is granted and this extension of penalty “by design” is recorded with Adjudicators for any future reference concerning Ms Wynne.

CONCLUSION:

Jockey Samantha Wynne’s Licence to ride in races is suspended from the conclusion of racing on 22 November, up to and including racing on 1 December 2023.
