Penalty: Jockey Samantha Wynne is fined $300

Background:

Mr Davidson alleged that in Race 9, Ms Wynne struck her mount ARE YOU CEREAL 6 times prior to the 100 metres.

Ms Algar demonstrated on the videos that the Respondent was racing towards the front of the field and struck her mount ARE YOU CEREAL 6 times prior to the 100 metres. Ms Wynne said she was counting and realised too late she had a made a mistake. She said she was trying hard not to breach the Whip Rules.

Decision:

As Ms Wynne has admitted the breach, it is found to be proved.

Submissions as to Penalty:

Mr Davidson produced the Respondent’s record which showed one breach in the previous 6 months, on 18 April when she was suspended for 5 days. He submitted a penalty in accordance with Guidelines was appropriate with a small uplift as ARE YOU CEREAL had won the race. Ms Wynne said she had been trying her best for the owners and had just got it wrong.

Reasons for Penalty:

The NZTR Guidelines provide for a fine of $250 where there is one additional strike, and the Jockey has a previous breach in the past 6 months.

Conclusion:

We accept Mr Davidson’s submission that a small uplift is appropriate. Ms Wynne is fined the sum of $300.
