BACKGROUND:

Following the running of Race 8, Champion Flour Premier, the Respondent Jockey, Samantha Wynne, admitted a charge alleging excessive whip use prior to the 100 metres.  It was alleged that, as the Rider of EULOGY SHOW in the race, she struck her mount with the whip 8 times prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not “strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)”.

EVIDENCE:

Mr Davidson showed video replays of the final 400 metres of the race. He pointed out EULOGY SHOW, ridden by the Respondent, in the lead as the field turned into the home straight. From that point, he showed, the Respondent use her whip 8 times prior to the 200 metres.

The Respondent accepted the alleged count of 8 strikes. She said that it was not good enough from her. She was in front a long way from home and it is a long straight. She was trying her best, she said.

DECISION:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

SUBMISSIONS FOR PENALTY:

Stipendiary Steward, Mark Davidson, said that the Respondent has two previous breaches of the relevant part of the Whip Rule on her record – on 1 October at Riccarton (6 strikes, fined $300) and, prior to that, on 15 October at Ashburton (6 strikes, fined $500). The Penalty Guide suggests a starting point for a third breach involving 3 additional strikes of a 5+ day suspension.

The Respondent said that she wished any suspension to commence after racing on the 3rd day of the meeting on 12 November.

REASONS FOR PENALTY:

This is the Respondent’s third breach of Rule 638(3)(g)(i) – using her whip more than 5 times prior to the 100 metres – on this occasion, 8 times. The NZTR Revised Penalty Guide suggests a starting point for penalty in such circumstances of a “Suspension 5+ National days”.

The Adjudicative Committee decided that the “5+”, in this case should be 6 days. There are no relevant aggravating or mitigating factors to be considered.

CONCLUSION:

The Respondent Jockey, Samantha Wynne, is granted a deferment until after racing on 12 November 2022. She is suspended from race riding from 13 November 2022 up to and including 23 November 2022 – 6 national riding days.
