EVIDENCE:

Following the running of Race, 2 Mr Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider, Ms Samantha Wynne.

Ms Wynne stated she understood the Rule, the Charge and confirmed she admitted the breach.

Mr Davidson played the final straight video to identify Ms Wynne finishing down the centre of the track and counted 7 strikes before the 100m. Mr Davidson said because there were a further 4 strikes from the 100m to the finish, a charge, as per the Rule has followed.

Ms Wynne said she was unaware that a shoulder strike would be counted.

DECISION:

The Respondent having admitted the breach it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Ms Wynne did have a clear record but infringed on Thursday at Wingatui 19 October. He said Ms Wynne was fined $250 as a first breach and the Penalty Guide shows a $500 fine for a second breach which the Stewards seek as Penalty.

Ms Wynne made no submissions for Penalty.

REASONS FOR PENALTY:

The Penalty Guide provides a $500 fine for a second breach with 2 additional strikes and the Adjudicative Committee considers there are no factors to depart from the Guidelines in this case.

PENALTY:

Jockey Samantha Wynne is fined $500.
