Background:
Mr Davidson alleged that in Race 1, Ms Wynne weighed in 0.6kg over her weigh out weight.
Mr Davidson said Ms Wynne was carded to ride at 54 and had weighed out at 54.4kg but had weighed in at 55kg. Ms Wynne said she was battling weight issues but with more riding she believed she would be fine. She explained she had had a big drink after weighing out and this was the reason for the breach.
Decision:
As Ms Wynne has admitted the breach, it is found to be proved.
Submissions as to Penalty:
Mr Davidson produced the Respondent’s record which showed no breaches of this Rule. He submitted a penalty in the range of $150 to $200 was appropriate. Ms Wynne did not disagree.
Reasons for Penalty:
This is Ms Wynne’s first breach of this Rule.
Conclusion:
She is fined the sum of $150.
