Background
Mr Davidson alleged that in Race 1, Ms Wynne struck her mount EMANON 7 times prior to the 100 metres.
Mr Davidson demonstrated on the videos that the Respondent was racing near the front of the field. She struck her mount EMANON 7 times in the home straight before the 100 metres and then 4 times in the last 100.
Ms Wynne said she had miscounted.
Decision
As Ms Wynne has admitted the breach, it is found to be proved.
Submissions as to penalty
Mr Davidson produced the Respondent’s record which was clear under this Rule. He submitted a penalty in accordance with the Penalty Guide was appropriate.
Ms Wynne accepted this.
Penalty
Ms Wynne has struck EMANON 7 times prior to the 100 metres. The NZTR guidelines provide for a fine of $250 where there are two additional strikes, and the jockey has a clear record.
Ms Wynne is fined the sum of $250.
