Penalty: Rider Chris Dell is suspended for 2 days and a $500 fine imposed
Evidence:
Following the running of Race 1 the Respondent admitted a charge of excessive whip use which was filed pursuant to Rule 638(3)(g)(i). Details are as follows:
“in that C Dell (Kentucky Boy) used his whip excessively prior to the 100 metres (6 times)”
The Respondent confirmed that he understood the Rule and admitted the breach.
Rule 638(3)(g)(i) provides that a rider must not
“strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)”Â
Using available film, Stewards identified that the Respondent struck his mount on 6 occasions, once before the turn and an additional 5 times prior to the 100 metre. There was a further strike just beyond the 100 metre mark. The Respondent agreed with the count. When asked for comment, he noted that he was not striking with force and was simply looking to keep his mount’s mind on the job.
Decision:
As Mr Dell admitted the breach the Adjudicative Committee found the breach proved.
Submissions for Penalty:
Mr Coppins outlined the recent record as follows:
6th June 2022 – $250 – 7 strikes
6th June 2022 – $500 – 7 strikes
27th August 2022 $500 – 6 strikes
The Adjudicative Committee were referred to the current Penalty Guide which provides for a starting point of 2 days suspension and $500 fine for a breach of this particular type. The Respondent did not offer comment, although sought deferment of any imposed suspension to enable him to satisfy commitments at the Marton Jockey Club meeting on 24th September 2022.
Reasons for Penalty:
The Adjudicative Committee considered evidence and submissions. The strikes, as alleged, were clearly demonstrated. There was no compelling reason found to depart from the current Penalty Guideline. As such, a 2 day suspension and a $500 fine is imposed.
Conclusion:
The Respondent’s request for deferment is granted, with his licence to ride in races suspended from the conclusion of racing on 24th September 2022 up to and including 28th September 2022. In addition, a fine of $500 is imposed.
