Evidence:
Ms V Algar, a Stipendiary Steward at the Manawatu Racing Club meeting on 27 August 2022 presented an Information charging Mr C Dell with a breach of Rule 638(3)(g)(i) (a Whip Rule) whilst riding “IFFIE SHOWS” in Race 8. As there was insufficient time for the Information to be heard at Awapuni, it has been determined today, 28 August 2022 at Matamata, at which Mr Dell had committed rides. It was alleged that Mr Dell used his whip 6 times on his mount prior to the 100 metre point.
The race film showed that after “IFFIE SHOWS” went into the lead upon entering the home straight it was struck with the whip 6 times prior to the 100 metre point, and vigorously ridden to the finish, and just caught close to the post so as to finish second, a head from the winner.
Decision:
As Mr Dell admitted the charge, it was deemed proved.
Submissions for Penalty:
Mr Dell has had 2 previous breaches of the Rule over the past 6 months, both being at Hastings on 6 June 2022, when he was fined $250 and $500. Mr Dooley, on behalf of the RIB, submitted that a fine of $500 was appropriate given that this was Mr Dell’s 3rd breach of the Rule.
Mr Dell made no submissions other than he accepted his responsibility.
Reasons for Penalty:
The Adjudicative Committee does not find any reason not to adopt the NZTR Penalty Guide for a 3rd breach of this Rule.
Conclusion:
Mr Dell is fined $500.
