Penalty: Jockey Chris Dell is fined the sum of $150

SUMMARY OF FACTS:

Following the running of Race 9 Mr Dell was charged in that he used his whip in consecutive strides inside the final 100 metres. 

The Rule provides that a Rider must not strike a horse with a whip in consecutive strides at any stage of the race.

Mr Neil Goodwin presented a video replay of the final stages of the race. It was demonstrated that Mr Dell struck his mount (Super Flash) in consecutive strides close to the finish post. Super Flash won the event. Mr Dell did not offer any specific explanation for his actions.

REASON FOR DECISION:

Mr Dell admitted the breach which is found proved.

SUBMISSION FOR PENALTY:

Mr Goodwin referred the Committee to the revised Penalty Guideline for improper whip use effective 1st September  2021. Same provides for a warning in a situation of 2 consecutive strikes. However, Stewards are afforded discretion to charge where  the breach takes place subsequent to a prior warning. Mr Dell was issued with a warning in relation to whip use in consecutive strides at the Marton Jockey Club meeting on 25th September 2021. Mr Dell confirmed recollection of the warning.  The breach is therefore  treated on the same basis as 3 consecutive strikes.

REASON FOR PENALTY:

Guidelines provide for a 1st offence breach penalty at the greater of $150 or 50% of the Jockeys share of the stake (calculated at $168). The Committee deemed a penalty of $150 is appropriate.

CONCLUSIONS:

Mr Dell is fined the sum of $150.
