FACTS
Mr Dell the Rider of “SUBTLE POINT” admitted a breach of Rule 638(3)(g)(i) in that he struck his mount with the whip 7 times prior to the 100m (5 is the limit).
Mr Dell said that he understood the Rule, Charge and confirmed that he admitted the breach.
Film replays clearly showed that 7 strikes had been applied prior to the 100m.
Mr Dell said that his horse came off the bridle and then he came out wide. He added that it was his first breach.
DECISION
As the charge was admitted, along with the clear film evidence, it was found proved.
PENALTY SUBMISSIONS
Mr Oatham said that Mr Dell had a clear record.
Mr Dell did not comment.

Taking into account the record and Penalty Guide, a fine of $250 was deemed appropriate.
