EVIDENCE:
Jockey Chris Dell struck his mount KINGFISHER LAD in two consecutive strides over the concluding stages. The film of the incident was shown and Rider Chris Dell confirmed his actions albeit in was only a stride short of the winning post.
DECISION:
As the breach was admitted, it was deemed proved.
SUBMISSIONS FOR PENALTY:
Stipendiary Steward Mr Goodwin informed the Adjudicative Committee that this was Mr Dell’s 3rd breach of the Rule. He had been fined on two previous occasions $150 on 7/10/021 and $500 on 14/11/021. He asked for a fine (as outlined in the Penalty Guide) to be imposed. Jockey Chris Dell agreed with Mr Goodwin’s submissions.
REASONS FOR PENALTY:
In keeping in line with the Penalty Guide, the Adjudicative Committee agreed that a fine was the appropriate penalty in the case.
CONCLUSION:
Mr Dell is fined $500.
