SUMMARY OF FACTS:
Following the running of Race 4, the Total Transport/Total Logs Maiden 1400m, Mr Goodwin presented an Information charging Mr C Dell with a breach of Rule 638(3)(g)(ii) in that he used his whip, when riding HYDRO DARCI, in consecutive strides in the home straight of the contest.
SUBMISSIONS:
Mr Coppins, using the race film, identified the facts that comprised the breach of the Rule by Mr Dell. His mount HYDRO DARCI when challenging for the lead very close to the finish line, whilst subject to a strong ride by Mr Dell – as he was entitled to do – was struck twice in consecutive strides. HYDRO DARCI finished 2nd, a short head from the winner.
Mr Dell, having accepted his breach, explained that when about 2-3 strides from the finish line, and very close to winning, he overlooked the Rule relating to use of the whip in consecutive strides wherever that occurs in the race.
REASON FOR DECISION:
As Mr Dell admitted the breach, it was deemed proved.
SUBMISSION FOR PENALTY:
Mr Coppins advised that Mr Dell has had a breach of the same Rule on 7 October 2021 for which he was fined $150.
Mr Dell said that he was “nearly on the post” and many Jockeys have found it difficult to adapt their styles to the Rule which had 2 elements – namely prohibited consecutive strikes anywhere in the race, and no more than 5 strikes before the 100 metre mark.
REASON FOR PENALTY:
As this is Mr Dell’s second breach of the Whip Rules, he is fined $500 in terms of the Penalty Guidelines (whether the Whip Rule offence is under subclauses (i) or (ii) of Rule 638(3)(g)).
CONCLUSIONS:
Jockey Chris Dell is fined $500.
