SUMMARY OF FACTS: Mr Williamson explained that Mr Kauri was challenging for the lead after rounding the bend for home. He commenced to use his whip and struck his mount 9 times prior to the 100m. Two of those strikes were on the neck and not at all forceful.

SUBMISSION FOR PENALTY: Ms Selvakumaran said this was Mr Kauri’s second breach of the whip rule and submitted a penalty in line with the guidelines would be appropriate.

REASON FOR PENALTY: Mr Kauri was fined $300 at Otaki less than 2 weeks ago for excessive use of the whip. He is an inexperienced apprentice rider but must learn from his mistakes. The Committee was concerned that Mr Kauri breached the rule in such a short space of time and explained that further breaches (inside the 6 month reset time) would likely result in a period of suspension. The starting point for a second breach is a $500 fine, and the Committee deemed that an appropriate penalty today.
