SUMMARY OF FACTS:

The Information alleged that he angled his mount outwards near the 800m when not clear of Danseuse.

The Rule requires that a Rider shall not ride a horse in a manner that the Committee considers to be careless.

Mr Kauri confirmed he understood the breach and pertinent Rule.

Video replays of the incident were shown. Approaching the 800 metre mark The Big Bad Wolf (Mr Kauri) was positioned  approximately 2 horse width off the fence behind Heid Belle (Mr R Hannam) who was sharing the lead with Gundahar (Ms C O’Beirne). The Big Bad Wolf was over racing toward the heels of Heidi Belle. Rather than take a hold Mr Kauri steered his mount out and into the path of Danseuse (Mr T Allan) when insufficiently clear. Danseuse was checked losing 2-3 lengths.

When asked for comment Mr Kauri confirmed that he agreed with the summary as presented.

REASON FOR DECISION:

As Mr Kauri admitted the breach, it was deemed to be proved.

SUBMISSION FOR PENALTY:

Mr Goodwin was asked to outline Mr Kauri’s record in respect careless riding breaches over the last twelve months. His record is clear. Stewards contended the breach was low to mid range and advised Mr Kauri should have made a greater effort to ease his mount.

Mr Kauri sought deferment to fulfil riding engagements.

REASON FOR PENALTY:

Upon consideration the Committee considers the breach sits low to mid range with a starting point for suspension being 6 days.  A 1 day reduction in penalty is considered appropriate to reflect Mr Kauri’s ready admission, his relative inexperience along with his clear careless riding record.

CONCLUSIONS:

Mr Kauri is suspended for 5 NR days from the close of racing on the 16th October 2021 up to and including 23rd October 2021.
