SUMMARY OF FACTS:

Following the running of Race 5 (Humphries Construction 1550), an Information was lodged by Ms V Algar alleging a breach of Rule 638 (1) (d) in that L Kauri allowed his mount THE MITIGATOR to shift in when insufficiently clear of JEWEL OF PATCH and CHARLIE HORSE shortly after the start.

Ms Algar had Mr Goodwin explain the incident using the available video angles. He showed Mr Kauri on THE MITIGATOR coming across the junction after jumping from barrier no 7. He was not the required distance distance clear of Ms Hirini who lost 2 – 3 lengths when forced to take a hold of her mount JEWEL OF PATCH. Ms Hirini was forced inwards onto CHARLIE HORSE, and those two runners bumped but Mr Goodwin said CHARLIE HORSE was over racing for Mr Mudhoo which exacerbated the incident.

Mr Kauri had  nothing to add.  Ms Clapperton explained that had Mr Kauri let THE MITIGATOR run along for another 10 – 15 m he would have been fine. In her opinion he had simply made a misjudgment when coming across as he did and had tried a bit too hard.

REASON FOR DECISION: Mr Kauri admitted the breach therefore the charge was found proved.

SUBMISSION FOR PENALTY:

Ms Algar said Mr Kauri had one previous charge of careless riding on October 7th this year where he received a 5 day suspension. The Stewards believed this was low end breach and submitted that a suspension was appropriate.

Mr Kauri advised of riding commitments through until Waverley on Sunday. Ms Clapperton said Mr Kauri’s riding has improved a lot over the last month, and Mr Kauri said this was in part due to him working hard on improving his fitness.

REASON FOR PENALTY:

In setting penalty, the Committee had regard to all submissions. Mr Kauri is an Apprentice Rider who has had only 65 race day rides. His inexperience no doubt played a part in the incident which resulted in two horses being affected with Ms Hirini losing 2- 3 lengths. Mr Kauri’s degree of carelessness sits in the low range but the interference that occurred was not low end. In line with the Penalty Guidelines the Committee adopted a starting point of 5 days suspension. Taking into account the degree of interference, Mr Kauri’s record and his Apprentice Rider status a five day suspension was considered appropriate.

CONCLUSION

Accordingly, Mr Kauri’s License is suspended from the close of racing on Sunday November 14th up to and including racing on Wednesday November 24th.
