Penalty: Apprentice Jockey Liam Kauri is suspended for 4 days

Evidence:

Following the running of Race 3, the “Mad Butcher Wanganui Maiden 1360”, Mr Goodwin presented an Information charging Apprentice Jockey Mr L Kauri with careless riding in breach of Rule 638(1)(d) in that he allowed his mount “TIPO” to shift inwards near the 1100 metre mark when not sufficiently clear of “HASBULLA” (Ms T Davies), which had to be checked.

Mr Kauri, assisted by Ms Clapperton, admitted the breach.

The race films, as referred to by Mr Goodwin, illustrated that Mr Kauri’s mount “TIPO” was racing away from the fence at the 1000 metre mark. “HASBULLA”, having been drawn No.1 at the start, was racing inside it.  Mr Kauri, in an endeavour to take the lead, allowed his mount to gradually shift inwards when no more than 1 length or slightly less clear of “HASBULLA” and Ms Davies, alert to what was developing, had to take hold of and check her mount so as to ensure contact did not occur.

Decision:

As the charge was admitted, it was deemed to be proved.

Submissions for Penalty:

Mr Goodwin advised that Mr Kauri had only just returned to riding after an enforced spell through injury; had no previous careless riding breaches and the carelessness was at the lower end of the scale, being an error of judgment.  He contended a suspension had to follow.

Neither Mr Kauri nor Ms Clapperton wished to make penalty submissions and Mr Kauri advised that he had no riding commitments in the next 7 or 10 days.

Reasons for Penalty:

The Adjudicative Committee accepted that this was low end careless riding but required Ms Davies to be alert and taking action so as to avoid a possible clipping of heels.  From a starting point of 5 days suspension, a discount allowance (initially said to be 2 days but later revised to 1 day) resulted in a penalty of 4 National Riding Days.

Conclusion:

Mr Kauri’s Licence is suspended for 4 National Riding Days, to commence at the conclusion of racing today, 22 February 2024 and to finish at the conclusion of racing at Matamata on 29 February 2024.
