Penalty: Apprentice Jockey Liam Kauri was fined $300

SUMMARY OF FACTS:

The Stewards lodged an Information with the Adjudicative Committee alleging that L Kauri struck his mount CANDY CROSS excessively prior to the 100 metres. Mr Goodwin used the video footage of the race to count the number of strikes which he estimated to be 8 or 9. Mr Kauri and Ms Clapperton both agreed with that number.

SUBMISSION FOR PENALTY:

Mr Goodwin said this was Mr Kauri’s first charge of any kind. He has been riding for only a few months and has had 15 race day rides.

Ms Clapperton explained that this was Mr Kauri’s first win and the adrenaline of being on a horse that was quickly gaining at the finish got the better of him. Mr Kauri agreed saying he hadn’t had to really use the whip on previous mounts and today it wasn’t on his mind to count.

REASON FOR PENALTY:

The Penalty Guide for Adjudicative Committees provides a starting point of $300 for a first breach of the Whip Rules when the number of strikes is less than 10. Mr Kauri fits into this category. He won the the race comfortably and the Committee was of the opinion that no uplift was required. It is not usual to apply any mitigation in penalty for whip breaches.

CONCLUSIONS:

Accordingly Mr Kauri is fined the sum of $300.
