EVIDENCE:

Following the running of Race 8, (the “Sep 11 – Harcourts Hats, Heels & Handbags for Hospice”), Mr Williamson presented an Information charging Apprentice Rider J Kamaruddin with a breach of Rule 638(3)(b)(ii) in that he struck his horse, SHE BRINGS ME RUBIES, with his whip excessively, prior to the 100 metre mark.

SUBMISSIONS:

We record that because the charge was heard some time after the conclusion of Race 8 when all Trainers had left the course, we regarded it as appropriate for a Senior Rider, Mr C Grylls, to assist Mr Kamaruddin who agreed with that course.

REASON FOR DECISION:

Mr Kamaruddin admitted the charge and it is therefore deemed proved.

SUBMISSION FOR PENALTY:

Mr Dooley demonstrated from the race film that Mr Kamaruddin struck his mount 6 times prior to the 100 metre mark.  He, along with all Riders attending today, were advised prior to races commencing, that breaches of the Rule would not be dealt with by warnings only as had sometimes happened in the past.  So all were on notice.

REASON FOR PENALTY:

Mr Kamaruddin was fined $300 for one prior breach of the Rule on 23 June 2021.  In line with the Penalty Guide a fine of $500 is imposed.  There are no aggravating or mitigating factors that require any adjustment.

CONCLUSIONS:

Mr Kamaruddin is fined $500.
