Evidence:
Following the running of Race 1, the “GENERATION HOMES ROTORUA”, Mr Dooley presented an Information charging Mr Kamaruddin with a breach of Rule 638(3)(f)(ii), in that he used his whip with an action that raised his arm above shoulder height when riding “STATE OF FEAR” in the home straight.
Mr Kamaruddin admitted the breach of the Rule.
Mr Dooley demonstrated the breach from the race films. Mr Kamaruddin’s mount “STATE OF FEAR” was challenging for the lead, under a vigorous ride, for the last 150 metres. It was struck 5 times by Mr Kamaruddin, with his whip action on each occasion, of him using an action that raised his arm above shoulder height. “STATE OF FEAR” finished 2nd, one half length from the winner.
Mr Kamaruddin did not make any submissions, either as to the circumstances of the breach or as to penalty.
Decision:
As the charge was admitted, it was deemed proved.
Submissions for Penalty:
Mr Dooley advised that Mr Kamaruddin had a clear record for breach of the Whip Rules.
Reasons for Penalty:
The Adjudicative Committee adopted a starting point of a $250 fine as recommended in the Penalty Guide. Whilst Mr Kamaruddin’s good record was mitigating, this had to be balanced by the fact that his actions enabled his mount to finish second, so no discount was given.
Conclusion:
Accordingly, Mr Kamaruddin was fined $250.
