Penalty: Apprentice Jockey Joe Kamaruddin is fined $500.

SUMMARY OF FACTS:

Following the running of Race 9, Joe Kamaruddin, admitted a charge alleging excessive whip use on his mount, ELIZABETH ROSE, prior to the 100 metres, in that he struck his mount 6 times.

Rule 638(3)(g)(i) provides that “in a Flat Race, a Rider must not strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins”. 

SUBMISSIONS:

Chief Stipendiary Steward, John Oatham, pointed out on video replays ELIZABETH ROSE, ridden by Mr Kamaruddin, in the run home. Mr Oatham showed the six strikes and submitted they were well short of the 100 metre mark.

Mr Kamaruddin accepted it was clear.

DECISION:

As the breach was admitted, the Adjudicative Committee finds the breach proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham, said that Mr Kamaruddin had two relevant prior breaches under this Rule.

  • 8 November 2022 at Pukekohe where he was given a warning for 6 strikes.
  • 19 November 2022 at Pukekohe where he was fined $250 for 6 strikes.

Mr Oatham submitted that the starting point was a $500 fine in reference to the Penalty Guide. Given that this was a Group 3 Race, it engaged the Black Type provisions, however, the $500 was greater than Mr Kamaruddin’s share in the stake.

Mr Walsh said that Mr Kamaruddin was a busy Rider, therefore, his record was pretty good.

REASONS FOR PENALTY:

The Adjudicative Committee agreed that a penalty in line with the Penalty Guide was appropriate. Accordingly, a $500 fine is appropriate.

CONCLUSION:

Mr Kamaruddin is fined $500.
