Penalty: Jockey Joe Kamaruddin is suspended for 5 days and fined $400

Evidence:

Following the running of Race 7, the “Lawnmaster Eulogy Stakes”, Ms Algar presented an Information charging Mr Kamaruddin with a breach of Whip Rule 638(3)(g)(i) in that he used his whip excessively in the home straight.

The facts of the offence, not disputed by Mr Kamaruddin, were depicted in the race film which showed that he, riding “MY LIPS ARE SEALED” struck his mount 6 times before the 100 metre mark and 6 further times after that and before the finish.  “MY LIPS ARE SEALED” was involved in a hotly challenged dispute between first and second place and was beaten into second by a bare nose margin.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Ms Algar referred to Mr Kamaruddin’s recent history of conviction for breach of the Whip Rule in October 2023, recent warning, and significantly, the admitted breach in Race 1 earlier in the programme today.  She referred to this race being a Group 3 Stakes Race (for 3 year old fillies, with a total stake of $100,000).

Mr Kamaruddin did not advance any submissions as to penalty.

Reasons for Penalty:

This was a Black Type Race for 3 year old fillies.  Apart from a suspension, some fine relative to the Rider’s earned percentage for second place, had to follow.  The fact that in an earlier race on this day, a similar whip breach had occurred, can be seen to be aggravating.  The overall impact of what are cumulative offences ought to be kept in mind.  A further 5 days’ suspension plus a significant fine, in the Adjudicative Committee’s view, is an appropriate and sufficient punishment.

Conclusion:

Accordingly, Mr Kamaruddin:

(a)  Is fined $400.

(b)  Licence to ride is suspended for 5 days, after his previous suspension ends on 1 January 2024.

That is to commence at the conclusion of racing on 1 January 2024 and to end at the conclusion of racing on 6 January 2024.
