Evidence
Following the running of Race 2, the Respondent Mr J Kamaruddin, admitted a charge alleging excessive whip use prior to the 100 metres.
Apprentice Mentor Ms K Clapperton, was present to assist.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);Â
Using the available race films, Mr Goodwin demonstrated that the Respondent struck his mount 6 times from the straight entrance to the 100-metre mark.
Mr Kamaruddin agreed that he had used the whip 1 more time than allowed. He had no further comment.
Decision
As Mr Kamaruddin admitted the breach, the Adjudicative Committee finds the breach proved.
Submissions For Penalty
Mr Goodwin produced Mr Kamaruddin’s record, which indicated two previous charges in the previous 6 month period:
25/3/23 Riccarton  6 strikes  $500
22/4/23 Auckland   6 strikes 2 day suspension + $500 fine
Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for excessive whip use (as of February 2023).
Reasons For Penalty
The Penalty Guide starting point for a third breach when 1 strike over the Guidelines, is a fine of $500.
After considering the film evidence, the submissions and having due regard for the number and frequency of strikes, the Adjudicative Committee determined there were no compelling reasons to depart from the starting point set out in the Penalty Guide.
On that basis, Mr Kamaruddin is fined $500.
Conclusion
The Respondent Mr Kamaruddin, is fined $500.
