FACTS:

Mrs Allpress admitted a breach of Rule 638(1)(d) in that she allowed her mount “STUMPY” to shift outwards near the 450m when not clear of “MATT CAIN” which was checked.

Mrs Allpress said that she understood the Rule, charge and confirmed that she admitted the breach.

Mr Goodwin identified the two horses on film replays and showed where the interference occurred.

He said Mrs Allpress and her mount were just a length clear when shifting out into “MATT CAIN”s line.

Mrs Allpress for her part said that there was little interference, that the gap had been given to her, but that her mount went a little wider that was needed.  She added that she thought that she was clear.

DECISION:

As the charge was admitted it was deemed proved by the Adjudicative Committee.

PENALTY SUBMISSIONS:

Mr Oatham said that Mrs Allpress had an excellent record with only one careless riding breach in the last 12 months, that being on 13 January 2022 when a 4-Day suspension was imposed.  He added that Mrs Allpress rides throughout the country.

Mr Oatham placed the carelessness in the low-range.  He reminded the Adjudicative Committee that the incident occurred in a Listed Race.

Mrs Allpress said that a suspension of her riding licence could start immediately.

REASONS FOR PENALTY:

The Adjudicative Committee took into account the record, low-range carelessness, the Penalty Guide and race status when fixing penalty.

A 5-Riding Day suspension was adopted as a starting point, with an uplift of one day due to it occurring in a Listed Race.

A one day discount was afforded for the admission of the breach and excellent record.

CONCLUSION:

Mrs Allpress’ Jockey’s Licence was suspended from 19 March through to and including racing on 30 March 2022 (5-Days).

(Tauranga 20 March and Otago 21 March were not taken into account as Declaration of Riders had closed).
