Evidence:

The Adjudicative Committee was furnished with an Information relating to Race 9 Hawkes Bay RI meeting of 6th June 2022. The Information outlined a breach of Rule 638(3)(g)(i) in that “L Allpress (OLD TOWN ROAD) struck her mount seven (7) times prior to the 100 metres”.

At the outset of  the hearing Mrs Allpress confirmed that she understood the charge and admitted the breach.

The Rule requires that a Rider must not “strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)”. 

Mr Coppins provided a film replay which clearly illustrated seven strikes prior to the 100 metre mark. Mrs Allpress agreed with the count and when asked for comment, expressed disappointment in her actions.

Decision:

Given the charge was admitted and film confirmed the number of strikes, the charge was found proved.

Penalty Submissions:

Mr Coppins confirmed that Mrs Allpress had a clear record in respect of a breach of this type. He recommended a fine in keeping with the current Penalty Guidelines – ie $250. Mrs Allpress did not offer comment.

Reasons for Penalty:

Taking into account record and Penalty Guide, a fine of $250 was deemed appropriate.

Conclusion:

Mrs L Allpress was fined $250.
