Background:

The aforementioned Information was lodged alleging a breach of Rule 340.

Details of the Information is as follows:

Following a fall in Race 8, Ms Allpress shouted to Ms Clapperton “hope you are f….n happy now Kim”

Mrs Allpress confirmed to the Adjudicative Committee that she admitted the breach.

Rule 340 provides ‘A Licensed Person, Owner, lessee, Racing Manager, Official or other person bound by these Rules must not misconduct himself in any matter relating to the conduct of Races or Racing’. 

Evidence:

Race 8 was a Rating 65 2040 metre event. On leaving the straight, TRAMORE (Apprentice Mr Liam Kauri) was seen to clip heels and blunder, with Mr Kauri suffering a heavy fall. The race continued. On pulling up and returning to scale, Mrs Allpress passed Ms Clapperton (Apprentice Rider’s Mentor) who was assisting in attending to Mr Kauri. At this point, the remark was passed.

Mrs Allpress expressed regret in having passed the remark.

Decision:

As the charge was admitted, it was found proved.

Penalty Submissions:

Mrs Murrow did not provide specific submission other than noting that breaches of this type had generally seen fines of $500 to $1500 imposed. Mrs Allpress asked that any penalty reflect that this had been her first Misconduct Charge.

Reasons For Penalty:

The current Thoroughbred Penalty Guide (February 2023) determines that any penalty is to be fact dependent. To assist, guidance is taken from previous penalties imposed for breaches of similar type. The Adjudicative Committee notes:

Kamaruddin – December 2022 – $200 fine

Lambert        – December 2022 – $500 fine

Pender          – February 2022   – $500 fine

In setting penalty, it is important that same reflects fact and circumstance particular to the offence. Nonetheless, in this case, the Adjudicative Committee feels it helpful to provide some context around the breach. Earlier in the day, there had been conflict between Mrs Allpress and Ms Clapperton. This, coupled with the emotion generated as a result of the fall, culminated in the remark. This, by no means, excuses Mrs Allpress.

A starting point, being a fine of $500, was deemed appropriate. A reduction of $200 was applied to reflect record, ready admission of the breach, along with demonstrated remorse.

Conclusion:

Mrs Allpress is fined a sum of $300.
