EVIDENCE:
Following the running of Race 2, Mr Oatham presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Mrs Lisa Allpress.
Mrs Allpress stated she understood the Rule, the Charge and confirmed she admitted the breach.
Mr Oatham played the final straight video to identify Mrs Allpress in second place as the field entered the straight, and counted 8 strikes before the 100m. He said Mrs Allpress has not struck her mount after the 100m.
Mrs Allpress agreed with the count.
DECISION:
The Respondent having admitted the breach, it was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham said Mrs Allpress has an excellent record, having no breaches under the Rule in the last 12 months.
Mr Oatham said a fine in line with the Guidelines is warranted.
Mrs Allpress made no submissions for Penalty.
REASONS FOR PENALTY:
The Penalty Guide provides a $500 fine for 3 additional strikes, first offence.
The Adjudicative Committee acknowledges Mrs Allpress has an outstanding record under this Rule for such a busy Rider. Unfortunately for Mrs Allpress, whip penalties are mitigation inclusive and the Adjudicative Committee considers there to be no extraordinary circumstances to depart from the Guidelines and accordingly, fines Mrs Allpress $500.
CONCLUSION:
Jockey Mrs Lisa Allpress is fined $500.
