Penalty: Jockey Kate Hercock is fined $500

Ms Hercock was charged with a breach of the Whip Rules following racing at Waverley on Saturday June 4th, however the hearing was held prior to the start of racing at Hastings on Monday June 6th.

Rule 638(3)(g)(ii) provides that in a Flat Race a Rider must not:

(ii) strike a horse with a whip in consecutive strides at any stage of the race.

Using the available race films Stipendiary Steward Mr Oatham demonstrated that Ms Hercock struck her mount 2 times consecutively over the concluding stages of the race. Her horse FABLUE ran second in the race.

Ms Hercock agreed that she had used her whip 2 times in succesion and accepted she had breached the Rules.

Decision

As Ms Hercock admitted the breach the Adjudicative Committee finds the breach proved.

Submissions For Penalty

Stewards submitted a penalty commensurate with the NZTR Revised Penalty Guide for  consecutive whip use.

Ms Hercock declined to make any penalty submissions.

Reasons For Penalty

The Penalty Guide starting point for a 4th breach of this nature is $500.

After considering the film evidence and the submissions the Adjudicative Committee determined there were  no aggravating factors requiring an uplift from the starting point set out in the Penalty Guide.

Conclusion

On that basis Ms Hercock is fined $500.
