Penalty: Jockey Kate Hercock is suspended for 5 NR days

Evidence:

Following the running of Race 6 the Respondent admitted a charge of excessive whip use filed pursuant to Rule 638(3)(g)(i). Details are as follows:

“in that she used her whip six times prior to the 100 metres”

The Respondent admitted that she understood the Rule and admitted the breach.

Rule 638(3)(g)(i) provides that a rider must not

” strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins)”

Using available film, Stewards identified that the Respondent struck her mount on six occasions between the top of the straight and the 100 metre mark. The Respondent did not offer comment beyond agreeing with the count.

Decision:

As Ms Hercock admitted the breach, the Adjudicative Committee found the breach proved.

Submissions for Penalty:

Mr Jones outlined Ms Hercock’s record as it related to this Rule. Her record over the last 6 months is as follows:

21/5/2022 – 6 strikes – $250

28/5/2022 – 6 strikes – $250

10/9/2022 – 6 strikes – $500

15/10/2022 – 6 strikes – suspended 3 days + $500

The Adjudicative Committee was referred to the current Penalty Guide which provides for a suspension of 5+ days for the 5th and following breaches within a six month period. The Respondent did not offer comment although sought deferment of any penalty to satisfy riding engagements at Wanganui on 26 November 2022.

Reasons for Penalty:

The Adjudicative  Committee considered evidence and submissions. The strikes, as alleged, were clearly demonstrated. On balance, imposition of a 5 day suspension is deemed appropriate.

Conclusion:

The Respondent’s request for deferment is granted, with her licence to ride in races suspended from the conclusion of racing on 26th November 2022, up to and including 3rd December 2022.
