Evidence:

Following the running of Race 4, the Respondent Class A Rider Ms K Hercock, admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that she permitted her mount JAMAICAN EXPRESS to shift outwards when not sufficiently clear of MCGRATH near the 300m.  

Ms Hercock acknowledged  she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films, Stipendiary Steward Mr Stewart demonstrated the incident and identified the horses and Riders concerned.

He said that approaching the 300 metre mark, Ms Hercock angled outwards when not sufficiently clear of MCGRATH, causing Mr Elliot to check his mount.

Ms Hercock had nothing to say in response.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submission for Penalty:

Stipendiary Steward Mr Goodwin, produced Ms Hercock’s riding record showing 4 previous breaches under the Careless Riding Rule in the last 12 months namely: March 2nd (4 days) and 19th (4 weeks), September 11th (5 days) and January 2nd (4 days).

Mr Goodwin assessed the level of carelessness to be in the low range and said that Ms Hercock did  not bother the Stewards very much.

Ms Hercock advised of riding engagements tomorrow only, and said any suspension could begin after then.

Reasons for Penalty:

After considering all submissions, the Adjudicative Committee determined Ms Hercock’s carelessness to be in the low range and adopted 5 days as the starting point. This conforms with the NZTR Penalty Guide (as of 1 February 2023).

The available films showed that Ms Hercock was only 1 length clear when she momentarily crossed in front of Mr Elliot, causing a slight check to MCGRATH. She immediately took corrective action by straightening her mount.

Ms Hercock is a busy Rider, today’s breach was minor and she readily admitted the breach. The Adjudicative Committee determined that a 1-day reduction was appropriate.

Conclusion:

Ms Hercock’s licence to ride in races is suspended for a period of 4 days commencing after racing on Saturday February 18th, and concluding after racing on Saturday February 25th.
