Penalty: Jockey, Kate Hercock is suspended for 4 national riding days

Following the running of Race 1 Ms Hercock admitted a charge relating to careless riding. The charge was issued under Rule 638(1)(d) which states:

A rider shall not ride in a manner which the Adjudicative Committee considers to be careless.

Details of the breach are as follows:

“in that K Hercock (SAINT OLIVER) shifted her mount outwards when not sufficiently clear of ASAHI (L Sutherland) which was checked near the 300 metres”

Stipendiary Stewards identified the incident through available film. Approaching the home turn SAINT OLIVER (Ms Hercock) is positioned 1 back on the fence behind the eventual race winner. To her outside is ASAHI (Ms Sutherland). Upon straightening SAINT OLIVER rolls off the fence when insufficiently clear of ASAHI causing Ms Sutherland to momentarily take hold of her mount. As a result ASAHI is forced out which in turn does also cause minor interference to MCCRAW.

When asked for comment Ms Hercock did contend that the inexperience of the horse did contribute to the incident. As an aside she did express concern that that there is not enough ‘calling’ going on in races particularly from the Apprentice Jockeys.

Decision:

As Ms Hercock admitted the breach it is deemed to be proved.

Submissions for Penalty:

Stewards conveyed that they considered the charge to represent a low range breach and referred to the current penalty guideline.  Ms Hercock recent record was provided and is outlined as follows:

Hawkes Bay 2/3/2022 – Low 4 day suspension

Wellington 19/3/2022 – Fall 4 week suspension

Waverley 11/9/2022 – Mid 5 day suspension

Ms Hercock did not offer comment in respect of penalty although sought that any suspension be deferred to enable her to satisfy riding engagements at Trentham on 7 January 2023.

Reasons for Penalty:

Upon considering all matters the Adjudicative Committee is satisfied that the actions of the Respondent did represent low range careless riding. The Penalty Guideline provides for a starting point of a 5 day suspension and this was adopted. The imposed penalty is reduced by 1 day ie: 4 days to reflect her ready admission of the breach. Such penalty is deferred to enable Ms Hercock to satisfy riding commitments.

Conclusion:

Ms Hercock’s Licence to ride in races is suspended for 4 national riding days commencing at the close of racing on 7 January 2023 up to and including racing on 13 January 2023.
