EVIDENCE:

The film of the incident where Miss Hercock is seen striking her mount 7 times prior to the 100 metre mark was shown. Miss Hercock had no comment.

SUBMISSIONS:

No other submissions were produced. Both parties agreed the film said it all.

REASON FOR DECISION:

The charge was admitted and deemed proved.

SUBMISSION FOR PENALTY:

Stipendiary Steward Neil Goodwin asked for a period of suspension to be imposed using the Guidelines as addressed under the Excessive Use of the Whip Rule.

REASON FOR PENALTY:

The Committee expressed concern that this was Miss Hercock’s 2nd charge today. While the horse she rode who she also trained Moonlight Hustler was having its first start she has an obligation as an experienced Licence Holder to ensure the Rules are adhered to. This breach coming so quickly after the first must be answered by an increased period of suspension. Remembering this was her 2nd breach today. Miss Hercock’s admittance and her very obvious remorse were noted.

Miss Hercock was suspended from race riding for a period of 6 days beginning after the completion of racing on Wednesday the 25th of November until the completion of racing Thursday 2nd of December.

The Committee imposed a fine of $150 reduced from its original thinking because of the obvious remorse and her undertaking to work hard on this facet of her riding.

CONCLUSIONS:

Suspension of 6 days fine of $150.
