Penalty: Class A Rider Lynsey Satherley, fined $300
Following the running of Race 10, the Respondent Ms L Satherley admitted a charge alleging excessive whip use prior to the 100 metres.
The Information alleged that Ms Satherley struck her mount JOSHUA BROWN 7 times prior to the 100 metres.
Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:
(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or
Using the available race films, Mr Dooley demonstrated that Ms Satherley struck her mount (JOSHUA BROWN) 7 times from the straight entrance to the 100-metre mark. He added that she then struck her mount a further 5 times inside the final 100 metres.
Ms Satherley said that she misjudged the 100-metre mark on the fence.
Decision
As Ms Satherley admitted the breach, the Adjudicative Committee finds the breach proved.
Submissions for Penalty
Mr Dooley advised that Ms Satherley has a clear record with regards to whip breaches within the reset period. He submitted that the Penalty Guide provides for a $250 fine. He said that Ms Satherley’s mount won the race by a narrow margin. He submitted the Adjudicative Committee may consider this an aggravating factor and apply a modest uplift to the starting point.
Ms Satherley had nothing further to add concerning the penalty.
Reasons for Penalty
The Penalty Guide starting point for a breach of this nature is a fine of $250.
After reviewing the films, it was noted that Ms Satherley’s mount finished the race off strongly. She won the race by a narrow margin and over the concluding 100 metres, she struck her mount a further five times. Although the additional strikes were not deemed as being excessive, nor were they considered to have been a determinative factor in her winning the race, a small uplift, as recommended by Stewards is applied, as it is deemed an aggravating factor.
Accordingly, a $50 (25%) uplift is applied to the starting point penalty.
Note:
It shall not be a contravention of the Rule if a Rider strikes a horse seven times prior to the 100-metre mark and does not strike the horse more than three times after the 100-metre mark. On this occasion, Ms Satherley struck her mount five times after the 100 mark. Thus, the reason for the charge.
Conclusion
Class A Rider Ms Satherley is fined $300.
